1. Overview

This Privacy Policy sets out the basis on which any personal data collected from the “Purchaser”, meaning the buyer or that the purchaser has provided to the “Seller”, meaning Garden Solutions will be processed. By visiting www.gardensolutions.info (https://www.gardensolutions.info) and providing personal data to the seller, the purchaser is accepting and consenting to the practices described in this policy.

Any questions about this policy, should be directed at enquiries@gardensolutions.info Under the Data Protection Act 1998 which is the UK’s implementation of the General Data Protection Regulations (EU GDPR), the seller has a legal duty to protect any information collected from the purchaser. This provides that the data the seller holds will be processed lawfully and fairly. It should be relevant, accurate and not excessive. The data controller is Garden Solutions, Dunaros, Ballencrieff Farm, Longniddry, EH32 0PJ.

The information will be kept up to date, where necessary, and not retained for longer than is necessary. It will be kept securely to prevent unauthorised access by third parties.

Leading technologies are used to safeguard purchaser data, with strict security standards and processes to prevent any unauthorised access to it. The seller will never pass on personal details to any third party unless given explicit permission to do so.

2. Exchanged Information

The seller collects details provided by the purchaser on registration together with information the seller learns about the purchaser from (i) the use of the service, (ii) from letters, (iii) telephone calls or emails and (iv) interactions with the website.

There may be times when the purchaser contacts the seller to update or change personal details or contact preferences. The information the purchaser gives may include the purchaser title, name, address, email address and telephone number.

The seller also monitors customer traffic patterns and website use which enables us to improve the service the seller provides to the purchaser.

If the purchaser opts to receive email updates from the seller, the registration information the seller collects is kept securely and any secure partner the seller may use to assist in contacting the purchaser and will be held until such time that the purchaser unsubscribes from said updates. This information is stored to allow us to send information that may be of interest to the purchaser and will never be given to any other party without the purchaser is consent (other than secure partners that the seller may use to assist us in contacting the purchaser).

The seller does not retain any financial information provided to us during purchases made by email or letter. This information is either permanently deleted from the electronic server or if in hardcopy it is cross shredded. This financial information is given over the phone for use on a card machine, it is never written down or verbally confirmed at time of presentation.

3. Storage of Information:

The information supplied by the purchaser is stored at Garden Solutions, Dunaros, Ballencrieff Farm, Longniddry, East Lothian, EH32 0PJ within the ordering processing system on computer, located within the central office building, which is password protected and has password restricted screensavers (starting at a short time period) to prevent any unauthorised access.

Any hardcopy information, of which is limited, is stored with a lockable steel cabinet of which only those of management or above level have access.

All stored information will only be held following the terms laid out in the archive destruction protocols. Mainly that all hardcopy materials are crosscut shredded, incinerated or pulped so they cannot be reconstructed.

4. Use of Information

Personal data supplied by the purchaser is used to arrange supply and delivery of goods and to contact the purchaser with catalogues and exclusive offers biannually.

5. Cookies

Cookies are small pieces of information sent by a web server to a web browser, which enables the server to collect information from the browser. The seller uses cookies for a number of purposes including (i) to simplify the identification process for registered users, (ii) to ensure the security and authenticity of registered users, (iii) to provide the mechanisms for online shopping and (iv) to enable traffic monitoring.

Non-registered visitors of the site are sent anonymous cookies to keep track of their browsing patterns and shopping behaviour. The seller may also use anonymous cookies if the purchaser has reached www.gardensolutions.info through an affiliate website to analyse the effectiveness of our marketing and to track any payments to those affiliates.

6. Credit Card Transaction and Security

For the security of the purchaser, authorisation for purchases will be checked with the credit card company before goods are dispatched. In addition our 128-bit secure server software (known as Secure Sockets Layer or SSL) is the industry standard and uses the best technology available to encrypt all of the purchaser personal information, including credit card number and personal details, so that these cannot be read as the information travels over the Internet.

Our card and online payments are processed by Tyl, a payment partner of NatWest. The seller does not retain a record of the purchaser Credit/Debit card details. Please consult terms and conditions of the Tyl service for more information on how data connected to the purchase is processed, used and stored by them.

7. Access rights

The purchaser has a right to see any personal data which the seller may have stored, correct any inaccuracies or request deletion of data directly related to the purchaser and removal from any mailing list.

Please note that confirmation of identity will be required before any data information is given out to the purchaser.

8. Changes to Privacy Policy

The seller reserves the right to update, change or replace any part of this Privacy Policy. Any amendments will be uploaded timely and it is the responsibility of the purchaser to ensure that they monitor changes to always be aware of what information the seller collects, and how the seller will use it. When the purchaser enters into a contract with the seller, they agree to this Privacy Policy.
